இந்த Appointment candidates obtained marks அடிப்படையில் தீர்மானிக்கப்பட்டுள்ளது.
அனைவரும் சட்டத்தின் முன் சமம் என்றால்.தேர்ச்சிபெற்ற அனைவரையும் சமமாகக்கருதி அனைவருக்கும் பணிவழங்க வேண்டிவரும். எனவேதான் சிலநடைமுறை கோட்பாடுகளை அரசு வகுத்துள்ளது.
ஆனால், பணிநியமனத்தில் எந்தக்காரணம்கொண்டும் Article 16
மீறப்படக்கூடாது.இதை முன்னிருத்தியே தற்போது உச்சநீதிமன்றத்தில் வழக்குத்தொடரப்பட்டுள்ளது.

to any office under the State.

(3) Nothing in this article shall prevent Parliament from making any law prescribing, in regard to a class or
