DeleteYou are exactly. I wish to say the same. The Govt should think the various litigation upon this exam since it was framed. No clarity. so the Govt can conduct one Competitive exam like PG TRB for those who have passed in TET 2012 & 13 ( marks above 82) and can select according to the Cut off marks. This is only the method would be acceptable by all. Pls excuse those who are against this method.

அப்படி என்ன ஜெயலலிதா , சாகும் போது 10 வீட்டி சட்டைகளும்,வெறும் 63 ரூபாய் பணமும் தனது சொத்தாக வைத்து விட்டு இறந்தாரே காமராஜர், அவரை போல் செய்து விட்டார்? அவரை அம்மா என்ற அனைவரும் ஏற்று கொள்வதற்கு?
தயவு செய்து எதற்காகவும் காமராஜருடன் இப்போதுள்ள எந்த அரசியல் தலைவர்களையும் ஒப்பீடு செய்யாதீர்கள்...அது உயர்த்தி பேச ஒரு நாளும் இருக்காது...தாழ்த்தி பேசவும் கூட அந்த ஒப்பீடு வேண்டாம்...அப்படி செய்தால் அதுவே நாம் அவருக்கு செய்யும் மிகப்பெரிய மரியாதை குறைவு...

நான் இந்த பதிவை எழுதியதே TET நண்பர்கள் judgement குறித்து தங்களுக்குள் விவாதிக் கொள்ள ஒரு platform ஐ உருவாக்கித் தர வேண்டும் என்ற நோக்கில் தான்.இந்த பதிவில் கூட ஏதேனும் ஒரு வரியிலாவது தமிழக அரசையோ,ஜெயலலிதாவையோ தவறாக குறிப்பிட்டு எழுதியதை ஏன் அவரின் பெயரையோ கூட குறிப்பிட்டுள்ளேனா என பாருங்கள். உண்மையில் முன்பு கருணாநிதியையாவது விமர்சித்து எழுதியது உண்டு.
நான் கூட இரட்டை இலைக்கு தான் வாக்களித்தேன்.ஏனெனில் ஏன் தொகுதியின் நிலை அப்படி இருந்தது.

"We, however, cannot hold that the subsequent decision of the Government thereby changing qualifying norms by reducing the minimum qualifying marks from 50% to 35% after the holding the examination and at the time when the result of the examination was to be announced and thereby changing the said criteria at the verge of and towards the end of the game, as justified for we find the same as arbitrary and unjustified. This Court in Hemani Malhotra vs. High Court of Delhi [ 2008 (7) SCC 11 ] has held that in recruitment process changing rules of the game"

ReplyDeleteKindly go through the following points carefully regarding relaxation to TNTET.
Relaxation was given to reserved categories such as SC/ST/OBC/PH through a circular dated 01.04.2011.
The NCTE for the first time decided on 5% relaxation to "SCs/STs etc." on 16.3.2011. Therefore, the decision to grant relaxation was taken before the first advertisement was published for holding the test. That advertisement was issued on 07.03.2012.The first TNTET examination was conducted on 03.06.2012 and supplementary examination was conducted on 14.10.2012.
Therefore, the Rules of the game had been laid down before the game started.(Nearly one year)
1. The Central Government has issued a notification on 31.3.2010 authorizing the National Council for Teacher Education (NCTE) as the 'Academic Authority' to lay down the minimum qualifications with reference to Section 23 of the Act.
2. NCTE has issued two notifications dated 23.8.2010 and 29.7.2011 laying down minimum qualifications of a person to be become eligible for appointment as a teacher for Classes I to VIII.
3. A candidate in order to become eligible for appointment as a teacher in a school in Tamilnadu is required in terms of these notifications to pass the Teacher Eligibility Test (TET) to be conducted by the ' Tamilnadu Government' in accordance with the guidelines framed by the NCTE for the purpose.
4. NCTE in its notification has provided relaxation of 5% in the qualifying marks for candidates belonging to reserved categories such as SC/ST/OBC/PH. This reservation policy is incorporated in the notification dated 29.7.2011 (P-3).
5. The matter of grant of relaxation upto 5% in the qualifying marks for 'SCs/STs etc' in accordance with the extant policy of the State Governments/ UTs and other school managements was considered by the NCTE in its meeting held on 16.3.2011, wherein it was decided to grant the relaxation upto 5%.
6. The decision taken is contained in NCTE letter dated 1.4.2011. It is recorded therein that NCTE had received representations from State Governments and others stake holders i.e. in respect of 'SCs/STs etc' that relaxation upto 5% marks should be allowed, since such relaxation is permissible by the NCTE for admission in various Teacher Education Courses.
7, Teachers Recruitment Board is designated as the Nodal Agency for conducting of Teacher Eligibility Test and recruitment of Teachers as per G.O. (Ms) No. 181,School Education (C2) Department, Dated 15.11.2011.
8. The first advertisement was published for holding the TAMIL NADU TEACHER ELIGIBILITY TEST (TNTET) – 2012 was issued on 07.03.2012 with Advertisement No. 04/2012. The examination was conducted on 03.06.2012.
9. The Tamilnadu Government was appointed as an appropriate Government only to conduct the Test in accordance with the guidelines framed by the NCTE as evidenced by the letter, of NCTE of 11.2.2011 (Annexure P-6). The letter dated 11.2.2011 (P-6) was issued to all State Governments enclosing guidelines for conducting TET.
10. Tamilnadu Government appear to have picked up the un-amended/old guidelines (page 32 of the paper book) and unknowingly planted them in the notification issued by the Chairman, Teachers Recruitment board, Chennai.

The respondents(Punjab Government) are directed to grant the petitioners the benefit of the relaxation and issue a rectified result and notify it immediately within 15 days from the date of receipt of certified copy of this order. Article 16:
Indian constitution says,
(4) Nothing in this article shall prevent the State from making any provision for the reservation of appointments or posts in favour of any backward class of citizens which, in the opinion of the State, is not adequately represented in the services under the State.
(4A) Nothing in this article shall prevent the State from making any provision for reservation[in matters of promotion, with consequential seniority, to any class or classes of posts in the services under the State in favour of the Scheduled Castes and the Scheduled Tribes which, in the opinion of the State, are not adequately represented in the services under the State.
(4B) Nothing in this article shall prevent the State from considering any unfilled vacancies of a year which are reserved for being filled up in that year in accordance with any provision for reservation made under clause (4) or clause (4A) as a separate class of vacancies to be filled up in any succeeding year or years and such class of vacancies shall not be considered together with the vacancies of the year in which they are being filled up for determining the ceiling of fifty per cent. reservation on total number of vacancies of that year.
In the speech of the Honourable Chief Minister of Tamil Nadu ( Jayalalitha) made in the Chief Ministers' Conference held on 10th April 1992 has categorically emphasised the stand of the Government of Tamil Nadu stating that the total reservation for backward classes, scheduled castes and scheduled tribes is 69%; that it is but fair and proper that socially and educationally backward classes (alone) as a whole should be given at least 50% reservation for employment opportunities in Central Government services and its undertakings as well as for admission in educational institutions run by the Central Government. It has also been pointed out that in consonance with this avowed policy, the Tamil Nadu Legislative Assembly passed unanimously a resolution on 30.9.1991 urging the Government of India to adopt a policy of 50% reservation for the Backward Classes instead of 27% and to apply this reservation not only for employment opportunities in all Central Government departments and Public Sector Undertakings, but also for admission in all Educational Institutions run by the Central Government.
These would be the possible findings and observations expected to be listed by the Honourable Justice.

(But, some points may be reflected in the judgement)
1. Nobody can raise questions against relaxation given to TNTET 2013 candidates which is against (Article 16, 4(a,b))..
2. The relaxation was attained by the untiring efforts made by various sectors of good people.(SC/ST commission, Mr.Prince Gajendrababu, Politicians who raised questions in Tamilnadu assembly and media in support of 2012 candidates)
3. Legal battles involving 2012 TNTET candidates and denial of their rights stating that Government’s Policy Decision.
4. As relaxation is given to 2013 candidates, without any effort towards relaxation,(they were not really expecting that), it must be extended to 2012 candidates with first priority.
5. The exam was conducted for one and half hours without any prior experience ( both TRB and the candidates).Later, TRB accepted its fault in fixing time period and tough level of question papers.
6. The pass percentage was only 0.06 and 0.02 % in first TET and 3.73 and 2.34 % in supplementary TET in paper I and II respectively.
7. Everyone has only one opportunity and one life. So many of the candidates have not applied for the 2013 exam. There is no need for applying every exam.
8. As the pass percentage was very less, candidates who got above 55 % would be very less in number in those two TNTET 2012 exams.
9. Moreover, TET eligibility certificate is valid for seven years.
10. If a person got above 55 % is considered pass for seven years in 2013, then why not the 2012 candidates? They can be considered as “PASS” for atleast six years.
Seven years validity is common in both batch of students. In the same period, those who got above 55 % in 2013 are considered “PASS” and those from 2012 who got above 55 % are considered “FAIL”.(against article 16)
11. SC/ST commission demanded the Tamilnadu Government to submit the action taken report regarding the un-filled vacancies in 2012.
12. Un-filled vacancies of 2012 must be filled by 2012 candidates only.
13. Priority must be given to 2012 TET candidates.
14. Nobody can say that 2012 process is “OVER”. 2012 batch recruitment process is still not over and CV for some vacancies were conducted during February 2014.Still the appointments were not posted.
15. Reservation was not followed in the 2012 recruitment process.(SC,ST,MBC,BC,BCM, PH, women, Tamil medium, etc).RTI can be applied to know the implementation of reservation made in 2012 recruitment process.
16. Weightage system could not be applied over the candidates studied during various periods.
17. Appointments can be made only on the basis of TET marks.
18. Weightage can be given based on Employment seniority and Teaching experience with a weightage of 40 marks out of 100.(TET mark for 60).
19. We can expect a wise and benevolent judgement.

Delete1.As per earlier court verdicts, the govt. cannot give relaxation after CV is completed. Hence no relaxation will be allowed for 2013 & 2012.
2.The govt may consider giving eligibility certifcate only for 2013 (82 - 89) candidates. NOT eligible for appointment.
3.The govt has formed a team under the leadership of Education Minister and it is empowered to adopt weightage system for appointment. Hence there is no question of change in it.
4.Reservation in TET exam is OPTIONAL as per NCTE guidelines. Hence the state govt may OR may not grant it. You may read the exact guidelines in this regard.
5.Finally, we should obey the court direction in this case, then only appointment can be made before MAY 2014.
SO WE SHALL WAIT FOR THE COURT VERDICT AND OBEY FOR IT.

Tamilnadu Govt.has not given relaxation based on court verdict and only in favour of their verdict.
Honourable CM announced 5% relaxation on 6.2.14 for 2013 candidates.
But the Higher education minister denied relaxation stating "Quality policy" on 5.2.14.He was not empowered to know this secret.
Reservation in TET exam is NOT OPTIONAL as per NCTE guidelines. Hence the state govt SHALL grant it. You may also read the exact guidelines in this regard.
Let us wait for a wise and benevolent judgement.

But due to various reasons,they came down and announced relaxation for 2013 only.
If they would have announced relaxation for 2012 also on 6.2.2014 then everyone would have blamed them for opposing reservation for two years.
Legally it would have been their acceptance on their part for denial of social justice for two years.
Moreover,they have not followed any reservation in 2012 appointments.
If they relax 2013 batch and prepare the list,they can hide alltheir mistakes.

ReplyDeleteRTE ACT passed all over India to appoint teachers up to 8th by conducting TEACHER ELIGIBILITY TEST.
Ncte framed the question pattern for conducting tet exams.
1. They included maths with science for both sci & mat candidates.
2. They included social for his/geo & language candidates.
Kept English & Tamil compulsory for all.
Framing qn by ncte aroused problems. But they hav the ans as northern states tchrs handle all sub-so that testing the knowledge in all sub is necessary. But in our state individual tchrs r get appointed. So our claim is that English tchr doesn't needed to check the knowledge of tam/sci/mat/his. This major thing in qn pattern prevented many tet candidates to clear the exam by scoring 90.
(Even engineering student can't ans the medical qn-even though they r talented. If the candidates r checked on their own subjects, many would compete & show their efficiency. NCTE 'prevented' the pass % in tet by framing wrong qn pattern!
Skilled tchr in subject how can compete with the skilled P.T tchr in running!! MHRD qns as both r tchrs! First of all tet qn pattern is meaningless. But it is passed as law under RTE act.)
In this situation tn govt announced recruitment & conducted 1st tet in 2012. Since it is very new only few passed. This created many waves in edn dept y overall candidates dropped below pass %. But the immediate job opportunity with handfull of govt salary aftr tet, kindled many degree holders behind tet exam. Many lamps r burnt midnight for becoming skill in other major sub. Unemployment among new degree holders created higher competition in tet exam.
Govt changed exam time & reduced the toughness in supplementary tet 2012. It some what increased pass % little. Nearly 20, 000 candidates cleared for the 1st time for appointment. Many submitted grievances to tn govt for 5% relaxation in tet as ncte given as it 'may' b decided on the basis of the state govt policy matter. Even hc disposed the relax writ. Strictly the govt denied 5% relax even for sc st ph candidates of 2012 -as only well qualified tchrs got appointed with no compromise in the quality. 'All tchrs' in bulk got appointed with grand fn by tn govt in dec 2012. This ignited many new & even senior degree holders to run with fire.
As a result, for around 15, 000 tchrs post more than 50, 000 got selected in tet 2013.
Once again 5% Relaxation grievances seriously aroused by many political parties (since lokh sabha election forthcoming) Once again few filed writ for 5% relax. At that moment, Thaalthapattor nala anaiyam condemned tn govt for not giving 5% relax for even sc st candidates. To avoid political parties (not by the compulsion of anaiyam) unwanted claims nearby lokh sabha election, tn govt come down & relaxed 5% & announced as 82-89 marks eligible from tet 2013.
Since bcos of the announcement of 5% Relax frm 2013, entire publication of final sel list of tet exam got stopped by trb. Above 90 scorers highly worried for the delay of appointment.
5% of tet 2013, got very happy.
5% of tet 2012, got collapsed y relax not announced frm 2012.
The enough time gap made the candidates to file many writs in hc. 2012 claimed relax in their writs. Few tet 2013 claimed not to relax even for 2013, since the game is over. Also against weightage mode writ got filed.
All writs r argumented & pending only for judgement. It would b judged before apr 30. Judgement wil mak drastic changes in appointment & lower or higher many candidates life. More than 70, 000 r competing for just 15, 000 posts.

ReplyDelete@ Claiming 5% 2012 relax & denying even 2013 relax blindly by tet candidates is mainly made only to protect their own job opportunity.
If 5% relax is given only frm 2014, 2013 above 90 candidates would b very happy & appointment for them is very bright for higher weightage scorers. But the relaxation announced as effect frm 2013. So, more than 25, 000 candidates 82-89 marks came in queue for competition with weightage marks. Only wit lower weightage mark of above 90 candidates would b affected by this relax. Higher weightage frm 82-89 get benefitted. Fear aroused among few tet 2013 candidates about the expecting judgement.
2012 candidates too claiming their own right for relax frm 2012 with priority in appointment than 2013 without weightage mode. State govt denied relax in 2012. If got relaxed, they got appointed a year before. But govt prevented their relax even their policy matter changed in 2013 on relaxation. So we wil give the result in hands of justice for tet 2012 relax.
In all previous verdicts of hc arguments, 2013 relax is argued as an ended game. So that the lawyers claimed as even 2013 relaxation is to b denied.
Another team claimed as, if 2013 is an ended game given relax, y come the ended 2012 wouldn't b claimed for relax!
(Govt didn't withdraw relax of 2013. Court even didn't interfer to withdraw. But Decision of 2012 relax is made if law allows & judge view on hard work of the candidates of 2012.
More than 6 candidates of harder tet 2012-not supplementary those who written in 1.5hrs & scored 82-89 claimed 2012 relax in hc writ.)
Argument ended. All awaiting for judgement.

This Court in Hemani Malhotra vs. High Court of Delhi [ 2008 (7) SCC 11 ] has held that in recruitment process changing rules of the game during selection process or when it is over are not permissible."
