பல்கலைக்கழகம், கல்லூரி, கல்வி மையம் ஆகியவற்றில், விரிவுரையாளர் பணியில் சேர்வதற்கான குறைந்தபட்ச தகுதியாக, நெட்/ஸ்லெட் தேர்வு, நிர்ணயிக்கப்பட்டுள்ளது. இதில், பிஎச்.டி., மற்றும் எம்.பில்., பட்டதாரிகளுக்கு, பல்கலைக்கழக மானியக் குழு (யு.ஜி.சி.,) விலக்கு அளித்திருந்தது. ஆனால், கல்வி கற்பிக்கும் ஆசிரியரின் தரம் உயர்வாக இருக்க வேண்டும் என்ற நோக்கில், மத்திய அரசு, இந்த விதி விலக்கை நீக்கியது. இதை எதிர்த்து, பிஎச்.டி., மற்றும் எம்.பில்., பட்டதாரிகள் சார்பில், மேல்முறையீட்டு மனுக்கள் சுப்ரீம் கோர்ட்டில் தாக்கல் செய்யப்பட்டன. அவற்றின் விசாரணைக்கு பின், நேற்று சுப்ரீம் கோர்ட் நீதிபதிகள், டி.எஸ்.தாகூர், ரோஹிண் டன் நாரிமன் ஆகியோர் அடங்கிய பென்ச் தீர்ப்பு வழங்கியது.
அந்த தீர்ப்பில் கூறப்பட்டுள்ளதாவது:
நாடு முழுவதும் ஒரே சீரான, உயர்ந்த கல்வி தரத்தை கொண்டு வரும் நோக்கில், மத்திய அரசு, யூ.ஜி.சி., அளித்த விதிவிலக்கை நீக்கியுள்ளது. இதில், தன்னிச்சையாகவோ, பாரபட்சமாகவோ மத்திய அரசு செயல்படவில்லை. மிகச் சிறந்த கல்வியை வழங்க வேண்டும் என்ற நோக்கமே பிரதானமாக உள்ளது. அதனால், மத்திய அரசின் விதிமுறைகளை நீக்க வேண்டிய அவசியம் இல்லை. அவை தொடர்ந்து அமலில் இருக்கும். இவ்வாறு, தீர்ப்பில் கூறப்பட்டுள்ளது.

In Tamilnadu Govt. Arts college lecturers' recruitment, the above mentioned rule is not properly adopted. The mark allotment for NET or SLET is very low. thus, they are penalized. Importance is given only to degrees, not for talent. If any one sues against the discrimination, they can surely win. recently, a lady from Madurai sues against TRB in this regard. The case is on. we have to wait for .....

The Supreme Court has upheld the regulations framed by the University Grants Commission prescribing minimum qualifications for national and state level entrance tests for appointment of teachers/assistant professor in colleges.
A bench of Justices T.S. Thakur and Rohinton Nariman dismissed a batch of appeals filed by PH.D/M.Phil holders challenging the regulations as revised by the Union government but said they would only be prospective.
In these appeals the constitutional validity of the UGC regulations (minimum qualifications required for the appointment and career advancement of teachers in universities and institutions affiliated to it) (the third Amendment) Regulation 2009 under which NET/SLET was to be the minimum eligibility condition for recruitment and appointment of lecturers in universities/colleges/institutions. Though the UGC exempted Ph.D and M.Phil candidates from the eligibility test, the Union government issued a circular including them in the regulations. While the high courts of Madras, Delhi and Rajasthan rejected the challenge, the Allhabad high court quashed the regulations. The present appeals are directed against these orders. Writing the judgment Justice Nariman said, “It is clear that the object of the directions of the Central government read with the UGC regulations of 2009/2010 are to maintain excellence in standards of higher education.

COIMBATORE: In an important judgement, the Supreme Court on Monday upheld the University Grants Commission (UGC) regulation on minimum qualifications required for the appointment of teachers in universities and affiliated to it.
The regulation states that the National Eligibility Test (NET) or State Level Eligibility Test (SLET) are the minimum eligibility conditions for appointment of assistant professors in colleges and universities.
The apex court has set aside the Allahabad High Court judgment dated April 6, 2012 which said the regulations were issued pursuant to directions of the Central Government which themselves were issued outside the powers conferred by the UGC Act and, hence, the conditions laid down would not apply to MPhil and PhD degrees awarded prior to December 31, 2009.
“The UGC itself does not appear to have given effect to this recommendation of the Thyagarajan Committee, which laid down that if six out of eleven criteria laid down by the Committee were satisfied when such a university granted a PhD degree, then such a PhD degree should be sufficient to qualify such person for appointment as Lecturer/Assistant Professor without the further qualification of having to pass the NET test,” the bench of Justice RF Nariman and Justice TS Thakur said.
“When the UGC itself has not accepted the recommendations of the said Committee, we do not understand how the High Court sought to give effect to such recommendations. We, therefore, set aside the Allahabad High Court judgment in its entirety,” the Bench ruled.
The Bench has also dismissed appeals against orders by the High Courts in Delhi, Madras and Rajasthan.
“It is clear that the object of the directions of the Central Government read with the UGC regulations of 2009/2010 are to maintain excellence in standards of higher education. Keeping this object in mind, a minimum eligibility condition of passing the national eligibility test is laid down. True, there may have been exemptions laid down by the UGC in the past, but the Central Government now as a matter of policy feels that any exemption would compromise the excellence of teaching standards in Universities/Colleges/Institutions governed by the UGC. Obviously, there is nothing arbitrary or discriminatory in this . In fact, it is a core function of the UGC to see that such standards do not get diluted,” the SC Bench observed.
