The annexure of GO no 181 is nothing but guidelines issued by NCTE. It stated that in page no 7 para 9 (a) that the govt may consider relaxation for reservation candidate. The relaxation was not given in 2012 as per above GO on the ground of no compromise in children education. In its letter addressed to education Secretary and trb chairman by the national commissioner of SC/ St under copy to Mr.prince Gajendra babu ordered the tn govt to impliment Go no 181.

May consider means it is not compulsion. It is a Government discretion. It is a Government policy decision.

HC refuses to relax standards, dismisses petitions
The requirement of a pass in the Teacher Eligibility Test for being considered for a post in State government or private school is mandated by RTE Act.
There cannot be different marks given in respect of different communal roster. If the State government does not consider relaxing the condition, it is not for the court to grant any direction for relaxing standards.
Justice K. Chandru made the observation while dismissing a batch of petitions in which the petitioners had qualified with a Diploma in Education.
They sought concession in the qualifying marks in respect of the TET conducted last year.
The judge said the counter affidavit rightly stated that the qualifying marks for a pass in TET had been fixed as 60 per cent.
The State government had taken a policy decision not to compromise on the quality of teachers and decided not to grant relaxation.
When the government had decided so, the judge said he was not inclined to consider the petitioners submissions.
No direction could be issued to the authorities to relax or lower the standards of teaching.

Yes. I accept the word may consider. But the govt has now consdered relaxation in 2013. As I already stated the govt could not refuse to give relaxation for 2012 . Because number of vaccancy were more than eligible candidate in 2012. But the situation became ulta in 2013. The time duration for first TET was 1.5 hours. The national commission for SC and ST has now intervene in this matter and direct the trb to impliment the GO. No 181

There is a limitation for court to interfere the Government Administration. Vise versa neither Court nor Government is supposed to interfere each others. That is why both Government and Court are struggling to solve the problem.

DeleteTET JUDGEMENT FACTS:

Nobody interfer(even high court & supreme court since relaxation procedure framed by ncte & only state govt hav the right to decide it as per RTE ACT 2009) in the tn govt policy matter for giving relaxation to 82-89 candidates. So writ against relaxation in tet 2013 wil b first disposed.
2. Then high court analyses tet 2012 relaxation writ & question the govt as why the relaxation is not extended to tet 2012.
Even though the policy matter of tn govt decided as relaxation applicable to tet 2013, govt is in the situation to produce answer in hc for denying relaxation for tet 2012. Atlast judge would direct the govt to 'consider relaxation for tet 2012 & supplementary tet 2012' as a justice since they r also equal to claim their constitutional rights.
If govt denies court wil direct to give relaxation only from next year tet 2014. This option wil not happen. Since relaxation tet cv for 2013 is going on. So opportunity for tet 2012 relaxation is very bright.
3. The next weightage writ. Even the tet candidate who scored tet mark above hav 76 weightage. But the candidate scored 85 mark surprising hav weightage above 85.
Year of passing in 10th & 12th, scorage of marks in different degrees, difference in allotment of marks in B.ED in various mode, providing same weightage mark for ten tet marks (from 82-89, 90-105) create lot of difference in gaining weightage mark which decide the appointment. So high court would seriously go through the weightage writ & decide the judgement whether that method is most suitable to select a talented candidate & also keep an eye as anybody get affecting.
(If weightage mode continues, hc wil give instruction for what weightage mode would b applicable for relaxation tet 2012. It would b preferred as appointment without weightage as followed in tet 2012 or weightage 36 with preference in appointment or any other suitable mode not affecting tet 2013.
In this crucial situation govt can even throw away weightage mode. Only this critical point disturbed tn govt to decide relaxation applicable only from 2013 & not from 2012.)
Anyhow more than 70, 000 & tet 2012 relaxation expecting candidates (around 4000) fights for just 15,000 teacher posts.
So judgement would b keenly observed & decided.
All r waiting for a better judgement. Many lives r to b changed by their important judgement.

ReplyDeleteToday there are so many cases relating to relaxation in 2012.
The proceeding of the case will continue only based on the advocate general's reply on behalf of Tamilnadu government.
If he gives the reply,we can understand the Government mentality.
If he is absent today,it would be delayed further.
The government will not oppose the relaxation for 2012,because there is no point in that.Because,those got 55% in 2012 were better than this batch.
One more point,it is election time.The reply will be published in media.They will not oppose,but
delay it.
The reason for not giving for 2012 while giving for 2013 was that it becomes an evidence that they have opposed the reservation for 2 years.All other parties will focus this.
Only court should decide.

There is no point in cancelling 2012 postings.But,2012 relaxation will be appointed first and 2012 will be over.
Then 2013 postings will be put.
Even the SC/ST commission has asked the Govt. to submit the action taken report on the backlog vacancies.
It is legally correct that the backlog vacancies must be filled by only the 2012 batch as per the last year method without weightage.
Justice Nagamuthu sir is well known for his wisdom and benovalence and deliver a positive judgement.

ReplyDeleteSources say that the 2012 candidates can quote this and get for their batch.
If they would have given for 2012 and 2013 same time, their purposeful delay may be questioned by all others.Then both may have got cancelled.
But,the Govt.has paved the way easily for 2012 keeping an eye on this in favour of 2012.
NCTE has given clear guidelines to state Govts. to decide the relaxation to be given to their state.As the G.O is published by the TN govt. nobody can oppose it evenif it is delayed.
Court may ask why it was not extended to 2012 and advice them to follow the same for all batches to establish social Justice.
There would be less than 3000 beneficiaries as Siranjivi stated.

(because if they follow the weightage system now what about previously selected candidates in 2012. Can that recruitment cancel.)
2. Relaxation should be followed only from 2014.
3. Existing weightage system need some modification.
4. Like TNPSC, TRB, BSRB etc., selection should be based on TET marks.

DeleteKindly once again read my comment posted by me at 10.45 a.m. lt doesn't hurt anybody. Am not spreading any rumours. Only u said for the first time. If u think my comment as rumour, u had not understood the real position going on. Do Understand the reality from tet origin.
All we should & must accept the judgement to b delivered by honourable high court.
Supreme court & high court doesn't interfer in relaxation of 5% marks in tet since it is framed as a constitution right & the state govt 'may consider it for relaxation'.
Before examination of tet 2012 & 2013 govt policy matter is there is no relaxation. (Not mentioned in tet 2013 prospectus. Only the line-state govt may consider relaxation present. So tet 2013 candidates can't claim against relaxation policy of tn govt.)
After tet 2013, tn govt changed the policy matter in tet relaxation marks & relaxed 5%.
Now we r expecting the relaxation to b extended up to 2012 also as a constituency right.
I had gone through most of the judgement delivered by hc, hc madurai & sc. Other judgements r not directly applicable to tet writs(ex: judgement of relaxation of mark after conducting exam is not applicable as ssid by sc). Becos any court should adopt only RTE act procedures. Ncte adapt those rules & instruct state govt to follow & conduct TET exams.
I knew am not a judge. But my lines r most judicious. If u r affected by my words, I feel for u. But truth alone triumphs following the constitutional law. All r equal & Judgement wil b applicable to all.
"A tet 2013 candidate who scored more than 105 with weightage above 85 hav a right to ask appointment for his her tet relaxation marks from 82-89 in tet 2012 with weightage 36 with preference in selection."

There is a limitation for court to interfere the Government Administration. Vise versa neither Court nor Government is not supposed to interfere each others. That is why both Government and Court are struggling to solve the problem.
